Terms and Conditions of Sale

§ 1

The owner of the online store www.grocerywala.pl is VISTULA FOODS SP. Z O.O., with its registered office in Warsaw, 02-168, at ul. Tapicerska 6A, m2. These Terms and Conditions define the rules for concluding transactions at www.grocerywala.pl.

§ 2

1. www.grocerywala.pl is an online store through which users can purchase the products offered there.

§ 3

1. Making purchases through www.grocerywala.pl requires the acceptance of cookies in the user's browser.

2. The Service works with a properly configured Google Chrome, Microsoft Edge, Mozilla Firefox, or other browser updated to the latest version and properly configured.

§ 4

1. To place an order, you must register on the store's website and complete the form provided on that page.

2. A properly completed form should include:

- email address and login password;

- confirmation of having read and accepted these Terms and Conditions and the Privacy Policy.

- customer's first and last name and address;

- shipping address and the first and last name of the person authorized to receive the shipment, if different from the customer's information (providing the first and last name of another person in the shipping information is equivalent to authorizing that person to receive the shipment);

- invoice information (if the Buyer wishes to receive an invoice);

- telephone number.

3. Ordering is completed by selecting the products, selecting the quantity, and clicking the "I am ordering" button. After confirming the selection, the User is redirected to the payment and collection method selection page.

4. The order can be collected in person at Vistula Foods' registered office without additional charge.

5. The order can also be delivered to the address specified by the Ordering Party for an appropriate fee, as indicated in the delivery price list. The selection of the collection method takes place after the order is completed.

6. After placing the order, the Ordering Party will receive an email confirming acceptance of the order.

§ 5

1. Prices of the Goods are given in Polish zloty and include VAT.

2. The Customer may pay for the Goods by:

- bank transfer to the Company's bank account number.

- electronic payment,

- upon collection.

§ 6

1. Delivery of Goods is limited to the territory of the Republic of Poland and takes place to the address specified by the Customer when placing the Order.

2. Ordered Goods are delivered by post, courier, or our own transport (delivery is free for orders over PLN 99). Any delivery costs will be indicated when placing the Order.

3. Delivery time is 2 to 7 business days from the date of receipt of payment for the Order or conclusion of the Sales Agreement with cash on delivery.

§ 7

1. If it turns out that the delivered goods do not conform to the order, the Ordering Party has the right to exchange the goods for the ordered goods or a new one.

2. The ordered goods are returned to Vistula Foods, which covers the associated costs.

3. Complaints are reviewed within 14 days. If the complaint is upheld, the Ordering Party will be sent a new item that conforms to the order.

4. If the ordered goods are unavailable but are not defective, www.grocerywala.pl will inform the Ordering Party by email or telephone. At the Ordering Party's option, the amount paid will be refunded to their bank account, or another item of the same price, selected by the Ordering Party, will be shipped. Shipping costs are borne by www.grocerywala.pl.

5. Pursuant to Art. 27 of the Act of May 30, 2014, on Consumer Rights (Journal of Laws of 2014, item 827)

Art. 27. A consumer who has concluded a distance or off-premises contract may withdraw from it within 14 days without giving any reason and without incurring any costs, except for the costs specified in Art. 33, Art. 34, paragraph 2, and Art. 35.

Art. 28. The period for withdrawal from the contract begins:

1) for a contract under which the entrepreneur delivers an item and is obliged to transfer ownership thereof – from the moment the consumer or a third party designated by the consumer, other than the carrier, takes possession of the item, and in the case of a contract that: a) covers multiple items delivered separately, in batches, or in parts – from the moment the last item, batch, or part is taken into possession; b) involves the regular delivery of items over a specified period of time – from the moment the first item is taken into possession;

2) for other contracts – from the date of conclusion of the contract.

Art. 29. 1. If the consumer has not been informed by the entrepreneur of the right to withdraw from the contract, this right expires after 12 months from the expiry of the period referred to in Art. 27. 2. If the consumer has been informed by the entrepreneur about the right to withdraw from the contract before the expiry of the period.

The withdrawal period referred to in paragraph 1 expires 14 days after the consumer is informed of this right.
